Orphan Drug Rule Rejected By U. S. District Court Judge

InsightsClient Alert

A federal judge issued a ruling on October 14, 2015, that is expected to have significant impact on rural hospitals that participate in the 340B Drug Pricing Program (340B Program).

Effective immediately, rural referral center, critical access, sole community and cancer hospitals participating in the 340B Program may not have access to 340B pricing on drugs designated as orphan drugs even if the drugs are used for nonorphan conditions.

Your hospital is listed as participating in the 340B Orphan Drug Program. You may be impacted by this new ruling and may soon experience higher pharmacy costs. Please take some time now to analyze the impact to your hospital.
